Florida Laws Regarding Payday Lending

Nineteen states have enacted laws that ban payday lending and Florida is one of them. Interest rates in Florida are limited by law to an Annual Percentage Rate (APR) of 18%. This limit applies regardless of the type of loan, whether it is payday loans, interest on debts, and lines of credit. Whether the interest rates are direct or indirect, all types of commissions or exchanges are subject to the state imposed limit of 18%. If a loan contract were to call for a higher rate of interest than Florida law allows, it would be considered usurious.

Loans for more than $500,000 are not subjected to the 18% APR limit mandated by the state of Florida. Mortgage related loans, such as those processed through the Veterans Administration or the Federal Housing Administration are also exempt from this limit. In addition, any government related mortgage loans or any loans that were processed before 1979 are exempt as well.

There are no payday lenders in the state of Florida.

Payday lenders can not loan more than $500 at a time since the state of Florida enacted a law setting that limit in July 2001. In addition, the state of Florida also capped the interest rate that payday lenders can charge. Borrowers in Florida cannot be charged more than 10% interest, which is one of the lowest rates in the United States.

Florida law restricts borrowers in that they are only allowed to take out one payday loan at a time. The same law mandates the payday lender to grant a 60 day grace period if the borrower is unable to repay the payday loan on time. There are terms and conditions that the borrower will have to meet in order to be granted the grace period, though. These include the borrower completing a credit counseling class and working out a payment schedule with the lender.

CS/SB 1526 and 314, sponsored by Senator Lee Constantine, imposes restrictions on Florida payday loans. This bill, which was successful and is now law, was the first of its kind in the state of Florida. Now, through credit counseling and by working out a repayment schedule, borrowers are able to get caught up and stay current on their payday loans.
